Welcoming a boisterous crowd to the Rose Garden for Cinco de Mayo, the President had a long list of people to recognize.  From Mexico?s Interior Secretary, Fernando Gomez Mont, to Ambassador Arturo Sarukhan, to esteemed Members of Congress, to Secretaries Solis, Napolitano, and Salazar (who was not in attendance), to the Maru Montero Dance Company and DJ Javier Cortes, it was a crowd more than worthy of recognition.

Q Are you committed to pushing forward on immigration law this year?

THE PRESIDENT: Well, I've made calls to Republicans to see if we can get them to join us. This is a difficult issue. It generates a lot of emotions, and the politics are difficult. But I've been unwavering in saying what we need to do. I think that I can get a majority of Democrats to support a comprehensive approach. But I need some help on the Republican side. We had that kind of help a couple of years ago. Senator McCain was one of the leaders in that process. I gave him a lot of credit for it, and still do.

BILL WOULD MAKE UNAUTHORIZED LAW PRACTICE 3D-DEGREE CRIME.

Legislation is on a fast track in the State of New Jersey Assembly would increase the level of criminality of practicing law without a license in New Jersey and create a civil cause of action for victimized clients. The bill, A-1050, backed by the State Bar Association and with no vocal opponents, would upgrade the unauthorized practice of law to a third-degree crime, punishable by a prison term of between three and five years and a $15,000 fine.

Supreme Court Decision Protects Right to Immigration Advice.

We applaud today’s Supreme Court decision on the right to counsel for noncitizens charged with committing a crime. The Court held that criminal defense lawyers must advise their noncitizen clients about the risk of deportation if they accept a guilty plea. The Court recognized that current immigration laws impose harsh and mandatory deportation consequences onto criminal convictions, and that Congress eliminated from these laws the Attorney General’s discretionary authority to cancel removal in meritorious cases.

U.S. CONSULATE IN CIUDAD JUAREZ CLOSING NOTICE.

In light of the recent shootings of US Consulate officials in Ciudad Juarez Mexico, the Consulate in Ciudad Juarez will be closed for the next few days. The U.S. State Department has also updated its warning on travel to Mexico to say it had authorized the departure of dependents of U.S. government personnel from consulates in Ciudad Juarez and five other northern border cities.

DOL SECRETARY SOLIS ANNOUNCES THE DEPARTMENT TO EXERCISE ITS AUTHORITY TO CERTIFY U VISAS

"On March 15, 2010 Secretary Solis announced that the Department of Labor (“DOL”) will begin exercising its authority to certify applications for U Nonimmigrant Status Visas ("U Visas")."  So, what is the big fuss, you may ask? Well, if U.S. employers take a close look at the rules and regulations . . . it means that the U.S. Department of Labor has another enforcement tool in its “bag of tricks.” The DOL can afford U Visa status to any foreign nationals that help the DOL investigate employers who are involved in Wage and Hour Violations and other Workplace Violations.  Employers need to be mindful (more then ever before) that they should carefully follow all of the DOL’s rules and regulations.

EMPLOYERS NEED TO KNOW ABOUT THE DIFFERENT TYPES OF USCIS SITE VISITS.

At a November 19, 2009 program put on by the Department of Homeland Security, titled "2009 Government and Employers: Working Togeether to Ensure a Legal Workforce," Ronald Atkinson, Chief of Staff of USCIS' Fraud Detection and National Security (FDNS) office, explained the three types of site visits that are currently being conducted.  It is important for employers to be aware of the different types of site visits, and to be aware that if any site inspections occur that they should contact an immigration attorney immediately to verify compliance.

Homeland Security Secretary Urges Congress to Move on Immigration Reform.

US Department of Labor Redesigned the Labor Certification Forms ETA 9035 (LCA) and ETA 9089 (PERM).

On February 9, 2009, the US Department of Labor held a "Public Briefing on Using the Redesigned Labor Certification Forms" in Baltimore, Maryland.  The purpose of the briefing was to educate stakeholders on the use of the redesigned ETA 9035 (LCA) and ETA 9089 (PERM).  At the briefing the DOL emphasized that the changes made to the forms are simply changes in the way data is collected; they do not constitute changes in policy.
