Travel and Border Crossing News: Know Before You Go

THe U.S. Department of Homeland Security, Customs and Border Protection Division ("CBP") frequently issues travel advisories and news for travelers entering and leaving th United States.  With the new Electronic Pre-Screening Program for Visa Waiver Countries ("ESTA"), and also the Western Hemisphere Travel Initiative ("WHTI") coming into effect this year for all land travel, it is in your best interest to "know before you go" if you are planning any international travel.

New Year's Resolution for US and Canadian Travelers: Get Appropriate Documents Now.

The Western Hemisphere Travel Initiative ("WHTI") is a U.S. law that requires all travellers, including U.S. and Canadian citizens, to present a valid passport or other approved secure document when entering the United States from within the western hemisphere. The U.S. WHTI is being implemented in stages by mode of transportation.

The new document requirements were implemented for air travel in January 2007. Final document requirements for those seeking to enter the United States at land or water ports of entry will take effect June 1, 2009.

The writing was on the wall! Foreign travelers to the U.S. who require visas (since 9/11) have to attend an in-person interview at a U.S. Consulate. Yet foreign travelers to the U.S. on the Visa Waiver Program ("VWP") do not need to undergo any scrutiny? Seem strange? Enter ESTA. The Electronic System For Travel Authorization ("ESTA") was created to provide information in the form of a database to the Federal Government about Foreign Nationals traveling to the U.S. on the VWP. The new program begs many questions. We hope that this electronic communication will assist you and your staff to properly comply with the ESTA program.
